DA’s Office 5th Worst Violent Felony Conviction Rate

Albany and Onondaga Fare Better Than Monroe County

The Monroe County District Attorney’s Office had the 5th worst violent felony conviction rate in 2006 for counties outside of New York City according to statistics published by the New York State Division of Criminal Justice Services.

“The true measure of a District Attorney’s Office is its ability to convict the most violent offenders,” said Cara Briggs, a former prosecutor with the Monroe County District Attorney’s Office who is challenging Democrat Mike Green in the November election. “Unfortunately, the latest data shows the Monroe County District Attorney’s Office, under Mike Green’s leadership, is failing to do that job for the residents of Monroe County.”

The conviction rate data, which is available on the Department’s web-site at http://criminaljustice.state.ny.us/crimnet/ojsa/dispos/index.htm, shows that in 2006 the Monroe County DA’s Office had a violent felony conviction rate of only 69.1%.  As the accompanying table shows, out of the 58 non-New York City Counties, Monroe County’s violent felony conviction rate ranks 54th.

The data also shows that the metropolitan counties of Onondaga (Syracuse), Albany (Albany), Broome (Binghamton), Westchester (Yonkers), Dutchess (Poughkeepsie), Nassau and Suffolk all had better violent felony conviction rates than Monroe County.  The Monroe County violent felony conviction rate of 69.1% is below the state average of 74.3% for non-New York Counties and a decline from the County’s 2005 violent felony conviction rate of 70.6%.

FELONY CONVICTION RATE ONLY 35%

DA’s Office Gets Felony Conviction in 1 out of 3 Felony Arrests

Our police are working hard every day arresting criminals who commit felonies in our community. Once a felony arrest has occurred, it is the job of the District Attorney to ensure that the felony arrest results in a successful prosecution.

Mike Green is failing to do that job for the residents of Monroe County.

District Attorney Mike Green's claim that the Monroe County District Attorney's Office "obtained convictions in over 90% of our superior court prosecutions" misleads the public regarding the actual felony conviction rate in Monroe County for 2006.

The actual percentage of felony convictions resulting from felony arrests in Monroe County for 2006 is 35%.  The 35% felony conviction rate is derived from data contained on the Monroe County District Attorney webpage, which reports 4,723 felony arrests and 1,662 felony convictions for 2006. In 2006, Mike Green’s Office obtained a felony conviction in approximately 1 out of 3 felony arrests.

"The simple math shows that, as District Attorney, Mike Green has been failing the citizens of Monroe County," said Cara Briggs, a former prosecutor with the Monroe County District Attorney's Office who is challenging Green in November's election.  "As District Attorney, I will ensure that felonies are competently prosecuted and our community is protected.”
